Employee State Insurance (ESI) is a social security and insurance scheme for workers.The ESI scheme protects the workers’ interest in case of contingencies like temporary or permanent disablement, employment injury, sickness, maternity, death by employment injury etc. The ESI scheme gives medical care to registered workers and their dependents through their well established network of hospitals, dispensaries across India. Registration under ESI is mandatory for every employer employing 10 or more workers. Every month the every worker earning less than Rs. 15000/-pays 1.75% of wages and employer contributes 4.75% of wages towards ESI payment. The collected funds is managed by ESI as per the Employee State Insurance Act, 1948.

Temporary and Permanent disablement benefits

From day one of entering insurable employment & irrespective of having paid any contribution in case of employment injury. Temporary Disablement Benefit at the rate of 90% of wage is payable so long as disability continues.

Subordinate Benefit

Dependants Benifits paid at the rate of 90 percent of wage in the form of monthly payment to the subordinates of a deceased Insured person in cases where death occurs due to employment injury or occupational hazards. "


The Act is based on employer’s / employee’s contribution. All contributions paid by the insured workers, their employers and income from other sources are pooled into a common fund called the Employees State Insurance Fund.

Disease Benefits

Sickness Benefit in the form of cash compensation at the rate of 70% of wages is payable to insured workers during the periods of certified sickness for a maximum of 91 days in a year. In order to qualify for sickness benefit the insured worker is required to contribute for 78 days in a contribution period of 6 months.

Medical Benefits

Full medical is distributed to an covered person and his family member's from the day he enters insurable employment. There is no calling on incidental charges of an insured person or his family member.

The employer must maintain employee register, accident register, inspection book, wage register and books of accounts.
Employer has to file half yearly returns of contribution paid. In addition an Annual Return has to be filed for details of changes in workers during the year.
ESI contribution for the month should be paid by 21st of the following month.
Employer has to pay simple interest @12% for delay in payment of ESI contributions. However, for not paying the ESI contributions of employee the employer is punishable under Indian Penal Code.
